Posting to Slovenia

An employer registered in an EU Member State (hereinafter foreign employer) may, for the purposes of providing cross-border services, post workers that he employs to work in the RS on the condition that he carries out a significant portion of his enterprise in the Member State where he is registered.

Types of posting

The posting of workers from a foreign employer to work to the RS in the frame of providing cross-border services is possible in one of the following ways:

  • the service is carried out on the account and under the supervision of a foreign employer under a contract concluded with the party for whom the service is intended;
  • the service is carried out on the account and under the supervision of a foreign employer without a contract concluded with the party for whom the service is intended, if it is the case of carrying out services for which the foreign employer is registered and which, by the nature of service, have no intended party;
  • the service is carried out on the basis of an act regulating the posting of workers to an institution or enterprise based in the RS with which the employer has a capital link;
  • the posting is carried out as a part of providing the work of the workers to a user with a seat or residence in RS.
